Know Your Rights: General

Fundamental constitutional rights that apply to everyone in the United States.

* When Interacting with Police

  • You have the right to remain silent - use it clearly by saying 'I wish to remain silent.'
  • You have the right to refuse consent to a search of yourself, your car, or your home.
  • You have the right to ask if you are free to leave.
  • If arrested, you have the right to an attorney - say 'I want a lawyer.'

If You Are Stopped by Police

  • Stay calm and keep your hands visible.
  • You may ask 'Am I being detained?' or 'Am I free to leave?'
  • In some states, you must provide ID if asked (stop and identify laws).
  • You do not have to consent to a search - say 'I do not consent to a search.'

* If You Are Arrested

  • Do not resist arrest, even if you believe it's unlawful.
  • Immediately say 'I wish to remain silent' and 'I want a lawyer.'
  • Do not answer questions or sign anything without a lawyer.
  • You have the right to make a phone call.

Recording Police

  • You have the right to record police in public spaces.
  • Do not interfere with police activity while recording.
  • Police cannot delete your recordings or seize your device without a warrant.
  • If told to stop recording, calmly assert your right but comply with lawful orders.
